Marmara University Faculty of Law, Department of Private International Law and Istanbul Arbitration Centre (ISTAC) organized the fifth session of panel series named “Arbitration School” on 27 February 2019, at Marmara University Haydarpaşa Campus.
Fatih Işık, the Founding Partner of Işık & Partners Law Firm, spoke at the panel on “Execution of arbitration agreements through representatives”.
In his speech, Mr. Işık addressed the specific authority requirement for a representative to conclude arbitration agreement on behalf of principal. Being one of the most controversial issues in international commercial arbitration practice in Turkey, Mr. Işık elaborated on the Turkish law provisions comparing them with the international practice. He also clarified the law applicable to the specific authority requirement mentioning relevant international arbitration awards and domestic court decisions.
